Section 1: Purpose

These terms and conditions of sale are agreed upon by Marthe-Agnès ARNAU, a sole proprietorship registered with the TOULOUSE Trade and Companies Register under number 539 635 664, hereinafter referred to as "The Seller," and any natural or legal person wishing to make a purchase via the website Quizoparty.com, hereinafter referred to as "The Customer." 

Any service performed on Quizoparty.com implies the Customer’s unconditional acceptance of these general terms and conditions of sale.

Section 2: Presentation of the products

Marthe-Agnès ARNAU is the author and holder of the intellectual property rights for an entertainment game sold in the form of a printable kit.

We draw the Customer's attention to the fact that its kits are intended for adults in order to enable them organizing children's birthday parties. The Seller will not be held responsible for any physical or material damage that may result from the use of its kits, which are used under the sole responsibility of the Customer.

To provide the Customer with the appropriate level of information on the Products prior to any purchase, the Seller provides a list of the main characteristics of the Products on sale on its website. Nevertheless, it is expressly agreed that the photographs of these Products presented on the Seller website have no contractual value. They are given for illustration purposes only and are as truthful as possible to the Products. These may however vary from the actual Products, especially regarding the rendering of colours.

Section 3: Order placement

The Customer can place their order through the "Add to my basket" icon available on the various pages of the website.

If the Customer already has an account on quizoparty.com he will have to identify himself with personal credentials, which are the identifier and password. If the Customer does not have an existing account, he will have to create one and fill in personal information (including full name, address, etc.). This data is collected to enable the Seller to fulfill the contractual execution of its service. It is protected in accordance with the provisions of Article 12 of these terms and conditions.

In all cases, the Customer will have the possibility to check and amend the information recorded. The Customer will then be invited to read and accept the present terms and conditions of sale (by checking the box "I have read and accept the general terms and conditions of sale").

Finally, the Customer will be taken to the payment page, where he or she will have the option to pay either by credit card or via PayPal. After having filled in payment information, the Customer will have to confirm the order by clicking on the button reserved for this purpose.

The Customer is informed of the registration and payment of the order as a message is displayed on the screen, followed by an email including the main elements of the order.

The data recorded by the Seller constitutes proof of the nature, content, and date of the order. The latter is archived by the Seller under the terms and conditions and in accordance with the relevant retention period. The Customer can access this archive by contacting the Customer Service Department using the Contact form on the website.

Section 4: Guarantees

In accordance with the legal provisions in force, the Seller is required to deliver goods that comply with the contract. This conformity is assessed in relation to the description of the Product on the QUIZOPARTY® website.

In the event that the Product does not conform to the contract, the Customer must contact Customer Service within two working days of receiving the Product, using the Contact form on the website, describing the reasons for the non-conformity. The Seller will contact the Customer in order to find the best solution to correct the non-conformity.

Section 5: Responsibility

The Seller shall not be held liable for the obligations of these General Terms and Conditions of Sale in the event that the non-performance of its obligations is attributable to:

  • The act of a third party, even if it is foreseeable,
  • The fault of the Customer
  • The occurrence of an event of force majeure as defined by the French courts, or to any other event that was not reasonably under the exclusive control of the Seller.

The seller declines all responsibility for direct and indirect damage, whether foreseeable or not, caused by the use of its website. In the event that the Seller liability should be established and held liable for damage suffered by the Customer and attributable exclusively to the placing of an order, the damages shall be limited to the amount of the order paid by the Customer to the Seller.

Section 6: Delivery of products for download

The customer receives by e-mail a hyperlink allowing him to download the files constituting the Product. The customer can also access these files in the "Order History and Details" section of his "My Account" space for a period of 30 days. During this period, the customer is invited to download his files which he can store on his computer in order to print them for his own needs for an unlimited period.

Once the files are downloaded, they will be considered as delivered and no new copy or refund will be sent to the customer.

Section 7: Product Price

The prices of the articles constituting the Product appearing on the Internet site are prices including all taxes expressed in the currency chosen by the customer and taking into account the VAT applicable on the day of the order. Any change in the rate may be reflected in the price of the items.

The Seller reserves the right to modify its prices at any time, it being understood, however, that the price shown on the site on the day of the order will be the only one applicable to the Customer.

Section 8: Geographical area

The online sale of the Printed Products presented on the site is accessible from any point in the world.

Section 9:  Payment methods and security

The website www.quizoparty.com has chosen the Prestashop Checkout Service by PayPal as its payment solution. This is an integrated and secure payment interface that offers a wide range of payment methods (PayPal, credit/debit cards, and other local payment options).

PayPal is a renowned international payment solution, ensuring secure payments in many countries worldwide. 

Section 10:  Modalities for exercising the right of withdrawal

In accordance with the French legal provisions concerning downloadable products, the Customer has no right of withdrawal once the files have been downloaded.

No new copy or refund can be sent to the customer.

Section 11: Collection of personal data

The Customer's personal data collected in the context of an order are processed by computer for the purpose of the Seller, as the person responsible for processing them, to enable the contractual execution of its service, i.e. the online delivery of its products and services.

Your personal data are confidential and will not be communicated to third parties under any circumstances. This data is also used to send you information about our parent-tester searches and new products, services and commercial offers in a timely manner, when you have explicitly consented to this.

This data is kept for a period of 6 years after the end of the contractual relationship and is intended only for the managers and internal services of quizoparty.com. Beyond that, they are simply deleted from our databases.

In accordance with the French "Informatique et Libertés" law of January 6, 1978 and the General Data Protection Regulation (EU) 2016/679 of the European Parliament and the Council of April 27, 2016, the Customer may at any time exercise his or her right to request access to personal data, rectification or deletion thereof, a limitation of processing, or object to processing, as well as his or her right to data portability, by contacting the Seller via the Contact form on the site.

The Customer also has the right to file a complaint with the Commission Nationale de l'Informatique et des Libertés (CNIL contact: 3 place de Fontenoy TSA 80715 75334 Paris Cedex - FRANCE 07 Tel: + 33(0)1 53 73 22 22).

Section 12: Intellectual property

All the graphic, visual or sound elements of our kits are registered and protected by the legislation relating to the royalties. They are strictly reserved for the personal use of the Customer in the private framework and cannot in no case be transmitted to thirds on a purely gracious or expensive basis.

The redistribution, in digital or printed form, as well as the use for commercial or non-profit purposes is forbidden without prior agreement from the publisher.

Any such use is unlawful and constitutes an infringement that may result in criminal and civil penalties.

Section 13: Attribution of jurisdiction

The present conditions are subject to French law. In case of dispute on the substance or on the form, the courts of Toulouse (France) will be only competent.

Section 14: Customer relations

The Customer can consult their order(s) by consulting the section “My Account” of the site, with their identifier and password. The Customer will be provided with updates on the status of their order by way of emails specifying the following main stages: Order registered, Payment received, Product shipping.
